Welcome to Kanneko. These Terms of Service ("Terms") govern your access to and use of the website kanneko-labubu.netlify.app, the AI driving assistant, and all related services (collectively, the "Service").
By accessing or using the Service, you confirm that you are at least 13 years old, that you have read these Terms in full, and that you agree to be legally bound by them. If you do not agree to any part of these Terms, do not use the Service.
If you use the Service on behalf of a company or organization, you represent that you have authority to accept these Terms on its behalf.
1. Description of the Service
Kanneko is a conversational artificial-intelligence assistant designed to accompany drivers. It provides voice and text responses about driving topics, navigational guidance, vehicle conditions, road safety, and general conversation. The Service is currently in early access (beta) and may change, be suspended, or be discontinued at any time without notice.
Kanneko uses third-party language models — currently Claude (Anthropic) and Gemini (Google) — to generate responses. We are not the authors of those models and do not control their internal behavior.
2. Critical road-safety notice
READ THIS BEFORE USING KANNEKO WHILE DRIVING.
Kanneko is a conversational assistant. It is not a certified road-safety system, it is not an approved navigation system, and it does not replace your judgment as a driver. You are solely and exclusively responsible for operating your vehicle safely at all times, regardless of any response, suggestion, alert, or information Kanneko provides.
By using Kanneko while driving, you acknowledge and expressly agree that:
- You must obey all traffic signs, road laws, and instructions from competent authorities at all times, even if they contradict what Kanneko says.
- Kanneko may suggest routes or roads that do not reflect actual road conditions — closed roads, collapsed bridges, floods, construction, or other hazards. Always verify road conditions with your own senses before proceeding. (Real cases: drivers who followed GPS toward destroyed bridges or flooded rivers without verifying the route have suffered fatal accidents.)
- Kanneko does not detect, and does not guarantee detection of, drowsiness, distraction, cognitive impairment, or any physical condition of the driver. Safety alerts are advisory and may not trigger in real danger.
- Kanneko's alerts, suggestions, and responses carry inherent delay from internet and AI processing. They are not real-time and must not be used as the sole basis for reacting to emergency situations.
- Kanneko does not replace the vehicle manufacturer, certified mechanics, the vehicle's ADAS systems, approved navigation devices, or emergency services.
- In a real emergency, call your local emergency services (911 or another local number). Do not ask Kanneko to do it for you.
- Your use of the Service while driving is entirely at your own risk.
3. Accuracy and limitations of AI-generated content
Kanneko's responses are automatically generated by artificial-intelligence models and may contain errors, inaccuracies, outdated information, or omissions, including on topics of road safety, mechanics, or navigation.
Reference case — Air Canada (2024): A Canadian tribunal held a company legally responsible for incorrect information provided by its AI chatbot, even when the chatbot acted autonomously. For this reason we state unequivocally: Kanneko makes no binding promises, guarantees, or commitments through its responses. No assistant response creates contractual obligations for Kanneko.
Specifically, content generated by Kanneko:
- Does not constitute professional legal, medical, mechanical, financial, or safety advice.
- Should not be the sole basis for any meaningful decision.
- May vary between sessions for identical questions.
- May reflect outdated training data (the model has a knowledge cutoff date).
- Does not guarantee the accuracy of any vehicle diagnosis derived from OBD-II data. A professional mechanical diagnosis always prevails over any Kanneko analysis.
- Does not include real-time verification of traffic conditions, road status, or weather; route suggestions are advisory and non-binding.
Kanneko assumes no responsibility for decisions you make based on the assistant's responses.
4. Vehicle diagnostics and OBD-II
Kanneko may provide advisory information based on OBD-II error codes or other vehicle parameters. This information is purely educational and does not constitute a certified mechanical diagnosis.
- The same OBD-II code can have multiple causes. Kanneko's interpretation may be incorrect or incomplete.
- Never make driving or safety decisions — such as continuing a trip with a warning light on — based solely on Kanneko's responses.
- For any mechanical alert, consult a certified mechanic. Kanneko does not replace a physical vehicle inspection.
- Kanneko is not responsible for vehicle damage, accidents, or financial loss resulting from following its diagnostic suggestions.
5. Eligibility and registration
To join the waitlist you must provide a valid email address. No account is required to use the demo. Do not allow anyone under 13 to use the Service. You are responsible for any activity that occurs from your session.
6. Acceptable use
You may use the Service only for its intended purposes and in accordance with these Terms. The following is expressly prohibited:
- Using the Service for illegal activities or activities that violate the rights of others.
- Attempting to access, alter, overload, or damage Kanneko's systems, APIs, or data through bots, automated scripts, fuzzing, denial-of-service attacks, or other methods.
- Reverse engineering, decompiling, or disassembling any part of the Service.
- Circumventing the Service's authentication, rate limiting, or access restrictions.
- Generating, distributing, or storing illegal, threatening, discriminatory, or offensive content through the Service.
- Reselling, sublicensing, or commercially exploiting the Service without Kanneko's written authorization.
- Using the Service in ways that may cause physical harm to yourself or others.
We reserve the right to suspend or terminate your access if we detect misuse, without notice or compensation.
7. Intellectual property
All rights in the Service — including the software, design, brand, logos, the Kanneko mascot, and original content — are owned by Kanneko or its licensors and are protected by applicable intellectual-property laws.
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. We grant you no other rights in our intellectual property.
If you submit suggestions, feedback, or ideas about the Service, you grant us a worldwide, royalty-free, perpetual license to use them without compensation.
8. Privacy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you also accept that policy.
9. Third-party services
The Service integrates third-party technologies (Anthropic, Google, Supabase, Netlify, Railway). Kanneko is not responsible for the practices, availability, accuracy, or content of those third parties. Their use is subject to their own terms and conditions. An outage in a third-party provider's services may affect Kanneko's availability without creating liability for us.
10. Beta service
Kanneko is in early access (beta). The Service may contain bugs, experience interruptions, produce incorrect responses, or change significantly before official launch. Your use during the beta is voluntary. We offer it "as is" during this stage.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of:
- Merchantability or fitness for a particular purpose.
- Accuracy, completeness, or timeliness of AI-generated responses.
- Continuous availability or freedom from interruptions.
- Freedom from errors, viruses, or harmful code.
- That the Service will meet all of your specific requirements.
12. Limitation of liability
To the maximum extent permitted by law, Kanneko and its operators, employees, agents, or partners shall not be liable under any legal theory (contract, tort, strict liability, or otherwise) for:
- Traffic accidents, vehicle damage, personal injury, or death related directly or indirectly to the use of Kanneko while driving.
- Damages caused by following routes, navigation suggestions, or road information provided by the assistant without the driver's independent verification.
- Damages arising from incorrect or incomplete vehicle diagnostics generated by the assistant.
- Decisions made based on incorrect, incomplete, or outdated AI responses.
- Failures to detect drowsiness, distraction, or other driver conditions, regardless of whether such features are described as functions of the Service.
- Loss of data, service interruption, or damages caused by third-party infrastructure providers.
- Indirect, incidental, special, consequential, or punitive damages of any nature.
Maximum liability cap: In any case where Kanneko is found legally liable, our total maximum liability to you shall not exceed USD $100 (one hundred U.S. dollars) or the amount you actually paid for the Service in the past 12 months, whichever is greater.
This limitation applies even if Kanneko has been advised of the possibility of such damages.
13. Indemnification
You agree to defend, indemnify, and hold harmless Kanneko and its operators from any claim, demand, damage, loss, liability, cost, or expense (including reasonable legal fees) arising from:
- Your use or misuse of the Service.
- Your breach of these Terms or any applicable law.
- Your violation of the rights of third parties.
- Any accident, injury, or damage you allege in connection with using Kanneko while driving.
- Unfounded, malicious, or frivolous claims brought against Kanneko.
14. Dispute resolution and arbitration
For any dispute, claim, or controversy arising in connection with these Terms or the Service ("Dispute"), the parties agree to first attempt good-faith negotiation for a minimum period of 30 days from written notice of the Dispute.
If direct negotiation does not resolve the Dispute, the parties agree to submit it to binding arbitration before a neutral arbitrator agreed upon by both parties, whose decision will be final and binding, except for legal grounds of nullity.
Class Action Waiver: By using this Service, you expressly waive your right to participate as a plaintiff or class member in any class action or representative proceeding against Kanneko. All Disputes must be resolved individually and not consolidated with the claims of others. This clause is an essential condition of these Terms.
The foregoing does not prevent either party from seeking urgent injunctive relief before a competent court where necessary to prevent irreparable harm.
15. Governing law and jurisdiction
These Terms are governed by the laws of the United States and the state in which the Service operates, without regard to conflict-of-law principles. For claims not resolved through arbitration, the parties submit to the jurisdiction of the competent courts of that location, waiving any other jurisdiction that might apply.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and without prior notice. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue in effect (including limitation of liability, indemnification, arbitration, and intellectual property).
17. Changes to the Terms
We may modify these Terms at any time. We will post the updated version with the revision date at the top of this document. Continued use of the Service after changes constitutes acceptance of the modified Terms. If changes are material, we will make reasonable efforts to notify you.
18. General provisions
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Kanneko regarding the Service.
- Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
- No waiver: Failure to exercise a right under these Terms does not imply permanent waiver of that right.
- Assignment: You may not assign your rights or obligations without our prior written consent. Kanneko may assign these Terms without restriction.
- Force majeure: Kanneko is not liable for delays or service failures caused by events beyond its reasonable control.
